| 1. Registration |

1.1 Anyone who wishes to use Printfac3’s printing service or receive news about our promotions must complete the online registration form on our Site first. Each customer is entitled to register 1 account only.

| 1.2 Registration is free. Anyone 18 years and above may register an account with Printfac3. |
| |
1.3 During the registration process, you will specify your email address and a password (your "Login Credentials"). You, are fully responsible for maintaining the confidentiality of your password and for any consequences that may arise from you having granted a third party access. Printfac3 has no duty or obligation to verify the identity of a customer and may assume, without independent investigation, that any person who logs on to this Site through your password does so with your consent and approval.

| 1.4 The management of Printfac3 reserves the right to remove a customer's account at its discretion without prejudice. |

| 1.5 You are required to provide and maintain a valid email address with Printfac3 at all times. |

| 1.6 You may close your account at any time. However, please email your request to us as proof. |

| 2. Customer Responsibilities |

| 2.1 Your use of the Site is subject to all applicable local, state, national and international laws and regulations. |

2.2 You represent and warrant that:
a) You are authorized user of this Site;
b) Any content that you transmit through this Site is not unlawful, including without limitation to matters that may be construed as invasion of privacy, violation of a right of publicity, a copyright, a patent, or a trademark infringement, and/or theft of trade secret or any other right of a person or party;
c) All information that you provide to Printfac3 on the Site is accurate and complete;
d) You will pay all charges incurred by you or any other users of your account and credit card at the prices in effect when such charges are incurred.

| 3. Ordering / Operations |

3.1 All orders must be submitted online. (Refer to Site for online ordering procedure)

| 3.2 Printfac3 reserves the right to reject any order that does not comply with the standard product specifications for output set by Printfac3 and stated on the Site. |
| |
3.3 Once you submit an order to Printfac3, it is considered a purchase. And once the status of your order changes to “print” in the Track Order page, it cannot be cancelled or changed.

| 3.4 Printfac3 will not provide colour proofing nor proofreading services. You are advised to proofread your artwork in preview mode on the Site before completing your order. |

3.5 Record of incomplete orders in Shopping Cart will be saved for maximum seven (7) days only.

3.6 Unless stated otherwise, all registered users may participate in Printfac3’s online and offline promotions. Your participation in any Printfac3 promotion acknowledges that you agree to abide to the terms and conditions for the relevant promotion.

| 3.7 Usage of Promotion Codes (Promo Codes) shall be according to the terms and conditions for the applicable promotion. Unless otherwise stated, Promo Code is considered null and void once it is used or when promotion expires. |

3.8 Printfac3 does not provide hardcopy of official receipts for purchases. You can print out all statements for your completed orders from the ‘Track Order‘ page on our Site.

3.9 If you are not satisfied with the outcome of your order, please e-mail Customer Service within 14 days after receiving your completed order. Please include your email address, order number and reason for dissatisfaction.

3.10 If you have not received your order within the specified delivery time, please contact Customer Service (CONTACT US) on our Site no later than 7 days from the date of the specified delivery time. Our Customer Service department will review your complaint and work with you to meet your expectations. You agree that any complaints or claims made to Printfac3 after 7 days will not be entertained.

| 4. Payment |

4.1 All prices and amounts shown on this Site are in U.S. Dollars (USD), unless otherwise noted. All payments made shall be in US Dollar.

4.2 You agree that all printing charges, shipping/handling fees for your purchases to be charged to your credit card.

4.3 You agree to pay in full the actual amount of your purchase. No refunds will be given if you pay more than the actual payment amount requested. Also, we will not proceed with your order if you pay less than actual payment amount requested.

| 4.4 Payment method: We accept Credit Cards (VISA, Mastercard and American Express) through PAYPAL(The Printfac3 Site is linked to www.paypal.com to help you understand more about using online payment.) |

| 4.5 You are assured that all information or transactions conducted online with PAYPAL are automatically encrypted using the Secure Sockets Layer (SSL) protocol with an encryption key length of 128 bits (the highest level commercially available). Therefore Printfac3 and its employees do not have access to your private information other then information voluntarily submitted to us through the Site. |

4.6 You must notify Printfac3 of any billing problems or discrepancies within 30 days after they first appear on your credit card account statement. You agree that if you do not notify Printfac3 within 30 days, you waive your rights to dispute such problems or discrepancies.

4.7 Printfac3 shall take legal action to prosecute any Customer whom we suspect of making fraud payments to us. We shall also remove that customer’s account and bar him/her from further use of our services.

5.2 Services, products, product prices and shipping rates do not include VAT and are subject to change from time to time.

5.3 Original prices of orders shown in shopping cart are also subject to change if regarded absolutely necessary by the Printfac3 management.

5.4 All goods are delivered to customers by Printfac3's appointed shipper/carrier.

5.5.1 Delivery time & cost is based on the selected product item. |

5.5.2 By default the delivery days for our products are as follows:-
Group A: 6 working days: Bookmark, Business Card, Envelope, Greeting Card, Letterhead, Menu, Flyer/Brochure, Postcard, Poster, Tent Card and Note Pad.
Group B: 10 working days: CD Jacket, Document Folder, Key & Card Folder and Presentation Folder
Group C: 12 working days: Paper Bag
For a combined product order (in a single receipt), the total shipping duration will follow the delivery days of the product with the longer days.
We will offer the 'Save Option' delivery when and if we are able to get a lower price from the shipping company. Save Option delivery days are as follows:-
Group A: 16 working days
Group B: 20 working days
Group C: 22 working days

| 5.5.3 Delivery time includes printing process time and the time taken for shipping. Estimated delivery time begins from date when order is placed. |

5.5.4 Working days exclude weekends and public holidays observed in your country.

5.6 For orders shipped with Save Option, order tracking via Air Waybill is not available.

5.7 Goods delivered to Printfac3 Customers are packed according to Printfac3’s standard packing. Once goods have left our premise, they are no longer our responsibility. As such, the risk of loss, custom clearance requirements and title for such items pass to you upon our delivery to the carrier.

5.8 Shipping delays may occur if local holidays are being observed.
|
| |
| 5.9 Printfac3 is not liable for any loss and damage suffered by Customers through any reasonable or unavoidable delay in delivery. |

5.10 If the incorrect goods were shipped to you, Printfac3 will reprint your order and deliver it to you at its expense providing you are able to provide to us by email, a photo of the wrong goods that were delivered to you. (Refer to clause #9)

| 6. Artwork File Preparation / Transfer |

| 6.1 When submitting your artwork file to us for printing: |

| |
6.1.1 All artworks should be saved into individual files and according to each order. |
| |
|
| 6.1.2 All artworks must be sent to Printfac3 through the Internet. (Please download artwork specifications from our Site to learn how to prepare file for uploading.) |
|
| |
6.2 When using our e-Template service, you agree to abide to the Terms of Use of the service.

| 6.3 To avoid delays or inconveniences, it is your responsibility to check that you have prepared your artwork according to Printfac3’s artwork setting specifications. |

| 6.4 Auto File Checking Process: |
| |
| Before ordering, you are required to upload your artwork file (PDF) for inspection by our auto file checking software which comes embedded in the artwork uploading module to ensure compliance with our selected PDF quality specifications. |
| |
| |
6.4.1 Auto file checking will only check for the following common errors encountered in artwork file (PDF): |
| |
| |
|
i. Uncurved / Unpath fonts
ii. Resolution below 300 dpi |
| |
|
|
6.4.2 Unless otherwise stated or informed, you are required to make the necessary corrections to the errors on your artwork file(s) as reported by the auto file checking system. Printfac3 will not accept responsibility for any consequences that may arise as the result of customer's failure to make the necessary corrections before output.
|

6.4.3 The auto file checking process cannot be considered as the final stage of artwork file checking and Printfac3 by no means acknowledges it as a complete solution for checking PDF/artwork files.
|
| |
6.4.4 Printfac3 cannot be held liable for any consequences in the event an artwork error in a preflighted artwork goes undetected.
|
| |
6.4.5 All artwork files that have been inspected by auto file checking will be stored on the Printfac3 server for a maximum of 72 hours. After which, Printfac3 will remove artwork file from server.
|
| |
6.4.6 All amended PDF/artwork file are required to go through auto file checking process again.
|
|
| |
6.5 If you make an error while placing your order, for example: accidentally submitting the same order twice, you must email to inform our Customer Service immediately. Printfac3 will not be responsible for any consequences arising from Customer's failure to inform customer service on time.
|
| |
6.6 You are required to resend your artwork for every repeat order, except for artworks saved in the Site’s artwork bank.
|
| |
6.7 Printfac3 is not responsible for customer's copyright infringement of artwork content.
|
| |
6.8 Printfac3 reserves the right to decline print jobs that contain literature or images that are pornographic or racially, religiously or politically offensive.

| 7. General Expectation on Printing Outcome |

7.1 Colour reproduction or accuracy is generally subject to the limitations of batch printing method. Therefore, the accuracy of colour reproduction is NOT guaranteed as stipulated in our Colour Disclaimer (Refer to clause #8).

7.2 We cannot be held liable for colour variations between jobs printed in different batches at different ordering periods.
|
| |
7.3 Due to other factors such as the different colour displays on various monitors, printed colours of end product may differ from what appears on your screen. Therefore Printfac3 cannot guarantee that the colours on what you printed will match exactly to what you see on you computer monitor.

|
| 8. Colour Disclaimer |

In order to provide an economical end cost to our customers and a quicker turnaround of the printed matter, Printfac3 groups together CMYK (4 color offset) work. This form of printing referred to as “batch printing” is used for the printing of Printfac3’s standard products, and marginal variations are to be expected from one print run to another.
As such, a 100% exact colour match is not possible. The most accurate means of colour matching entails printing the job in isolation (entire-run print) as a stand alone job which will drastically increase the cost of a print job.
Moreover, due to other factors such as the different colour displays on various monitors, printed colours of end product may differ from what appears on your screen. Therefore Printfac3 cannot guarantee that the colours on what you printed will match exactly to what you see on your computer monitor.

| 9. Product Refund / Reimbursement Policy |

| 9.1 We will only refund or reprint orders for the following conditions: |

9.1.1 Order fails to meet the conditions under the General Expectation on Printing Outcome (Refer to clause #7). However, we are not responsible for typing, image, or design errors introduced by customers in the artwork/document creation process. In an effort to keep costs down and pass those savings along to our customers, Printfac3 does not review artwork/documents for content or spelling. In no way shall either Printfac3 or its subsidiaries, officers, directors, shareholders or employees be liable for any special incidents, indirect or consequential damages, mistakes or rejects of any kind whether or not the party has been advised of the possibility of such damages or rejects arising out of or related to an Printfac3 Customer's action(s). The Terms of Use constitute all terms and agreements relating to Customers participating in the Printfac3 Customer Program.

9.1.2 Order is damaged or lost by our appointed shipping company. In such cases, sufficient evidence must be presented. Therefore, we reserve the right to have you return the original order, at our cost, before reprinting or refunding your order.

| 9.2 If applicable, all refunds or reimbursements for only the conditions stipulated in 9.1.1 and 9.1.2 will be made through PAYPAL. |
| |
9.3 For order cancellation (while the status is still ‘NEW’ in the track order page) we will issue an eVoucher code via email to customer. Unless stated otherwise, such eVouchers are valid for only 180 days from the date of issuance (stated on email) and are a non-transferable or for re-sale. You may use such an eVoucher code to place a new order on our website within the validity period. Unless otherwise stated, an eVoucher code is considered null and void once it is used or expires.

| 10. Printfac3’s Intellectual Property Rights |

The names, text, images and logos identifying Printfac3 and their products and services are subject to copyright, design rights and trademarks of Printfac3. Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any license or right to use any trademark, patent, text, design right or copyright of Printfac3. Unless stated in written consent, a Customer or party has no right to produce, copy, disseminate the names, text, images and logos identifying Printfac3 and their products and services. If Printfac3 suspects a Customer has violated this condition, Printfac3 reserves the right to remove that Customer's service account. Printfac3 also reserves the right to take legal action against any Customer who misuses any trademark, patent, design right or copyright of Printfac3.
Customers may not link materials or info summary from Printfac3 Site to their site or blogs providing written permission from Printfac3 is attained first. Customers acknowledge that they do not acquire any ownership rights by downloading or republishing copyrighted material from the Printfac3 Site. However, customers agree to remove any material or info summary that originated from the Printfac3 Site and posted on their site or blog if requested by Printfac3. |

| 11. Copyright Policy |

By using the Printfac3 Site and the services offered on the Site, you are representing that you have full right to use the copy, design and the images in your artwork and are not infringing the intellectual property rights of third parties. You also recognize that an image, graphic or text does not have to bear a copyright notice in order to be protected by copyright law, so absence of such notice does not necessarily assure a right to reproduce. You further warrant that no copyright notice has been removed from any material used in preparing your Content for reproduction.
You agree to indemnify and hold Printfac3 and its subsidiaries, officers, directors, shareholders or employees harmless from any loss, liability, claim, demand, damage, cost and expenses, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, or transmit through our site.

| 12. Contributions to the Printfac3 Site |

While customers are invited to submit any contribution to the Printfac3 Site (including any text, photographs, graphics, video or audio) customers agree, by submitting their contribution, to grant Printfac3 a perpetual, royalty-free, non-exclusive, sub-licenseable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to their contribution worldwide and/or to incorporate their contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution, and in accordance with privacy restrictions set out in the Printfac3 Privacy Policy. If customers do not wish to grant Printfac3 the rights set out above, customer is prohibited from submitting his/her contribution to the Printfac3 Site.

| 13. Governing Law |

PRINTFAC3 c/o EXCARD CORPORATION SDN BHD is incorporated in Belize City, Belize. All transactions take place on Printfac3’s servers located in Malaysia. Issues related to the protection, infringement, or misuse of copyrighted materials shall be governed by the copyright laws of Malaysia. All other matters relating to your access to or use of this Site shall be governed by the laws of Belize. Any legal action or proceeding relating to or arising from your access to or use of this Site shall be instituted in Belize City, Belize. You agree to submit to the jurisdiction of Belize courts and agree that venue in these courts is proper in any such legal action or proceeding to the degree this is not otherwise regulated in mandatory consumer protection laws.
Customer agrees that any claim against Printfac3 must be filed within 1 year of the time such claim arose, regardless of any law to the contrary, Printfac3 reserves the right to bring any action for injunctive relief or collection of debt in any court of competent jurisdiction. |
